Cơ quan tôi là đơn vị hành chính sự nghiệp được cấp trên cấp dự toán .Tháng 1,2 năm 2008 do dự toán cấp muộn, nên đơn vị tôi nộp BHXH muộn, BHXH chưa gửi thông báo về việc yêu cầu đơn vị tôi nộp số tiền BHXH. Nhưng đến đầu tháng 3 đơn vị tôi sang làm việc với cơ quan BH để nộp số tiền BH chưa nộp thì cơ quan BH yêu cầu ngoài số tiền BH phải nộp đơn vị tôi còn phải nộp tiền lãi do nộp muộn của tháng 1 mà chúng tôi chưa hề được cơ quan BH gửi thông báo yêu cầu. Vây, cơ quan Bảo hiểm làm vậy là đúng hay sai

 Theo quy định tại điểm a khoản 3 Điều 7 và Điều 13 Nghị định 135/2007/NĐ-CP của Chính phủ về xử lý vi phạm hành chính trong lĩnh vực bảo hiểm xã hội thì cơ quan BHXh yêu cầu cơ quan bạn phải nộp tiền lãi do nộp muộn tiền BHXH là đúng với quy định của pháp luật.
